Convicted Rapist Gets No Jail

(Brockton, Massachusetts) Despite the prosecution's recommendation and the desires of the victim's parents, Judge Suzanne V. Delvecchio ruled that former teacher and child rapist, 26-year-old Gregory Pathiakis, hadn't been naughty enough to warrant any jail time.

After pleading guilty in Brockton Superior Court to one count of rape of a child, enticement of a child under 16, five counts of possession of child pornography and one count of distribution of harmful material to a child, Delvecchio gave him a suspended sentence and probation.

The case against Pathiakis resulted after a 15-year-old boy told authorities that the Middleboro High School teacher had raped him in December 2003. The teen stated he was subsequently forced to leave Middleboro High to be home schooled.

The prosecutors expressed disappointment in Delvecchio's decision but stopped short of being openly critical. The victim's parents feel cheated. I think it's a hand slap, at best. The only substantive element of Pathiakis' sentence appears to be a requirement to register as a sex offender. He'll probably take care of that as he walks out the door.
