An Orange County jury found a Laguna Niguel hockey mom guilty of sexually assaulting a 16-year-old boy but could not reach a verdict Thursday on whether she did the same to a 13-year-old.

Superior Court Judge W. Michael Hayes declared a mistrial for Kathia Maria Davis, 45, on four felony counts of lewd acts on a child younger than 14 on which the panel of 10 women and two men was hung along gender lines in favor of conviction after a day and half of deliberations.

Prosecutors said they will retry Davis on those counts.

The panel found Davis, a divorced mother of three, guilty of four counts of unlawful sexual intercourse with the older boy and two misdemeanor counts of contributing to the delinquency of a minor, one for each boy. The jury acquitted her of one count of contributing to the delinquency of a minor in which she was accused of providing marijuana to her son.

Davis, who fought back tears as she was handcuffed after the verdict, faces a maximum of five years in state prison for the conviction. Hayes set the retrial and sentencing for Nov. 5, but Davis likely will be sentenced after her second trial.

(Orange County, California) Arrested and released on bond in September 2011, 44-year-old hockey mom Kathia Maria Davis appeared in court yesterday and pleaded not guilty to sexually assaulting her son's hockey teammates.

Prosecutors say Kathia Maria Davis served her two victims alcohol and then engaged them in sex acts, in some cases with her children still in the house. The two boys – one 13 years old at the time, one 16 – played hockey with her son on the Beach City Lightning youth team, authorities said.[…]

Davis met the 13-year-old boy in 2005 through her son's hockey team, according to the Orange County District Attorney's Office. She let her son and the boy drink alcohol during a sleepover, prosecutors said. She later kissed and engaged in a lewd act with the boy, prosecutors said.

More recently, Davis met the 16-year-old boy through the hockey team and had sex with him four times between mid-2010 and mid-2011, prosecutors say. The illegal sex happened in her bedroom, with her two children in the house on some of the occasions, according to the District Attorney's account.

A pre-trial hearing is scheduled for early January. Davis is free on $100,000 bail.

California Mom Accused of Sex with Boys

(Orange County, California) A 44-year-old divorced woman, Kathia Maria Davis, has been accused of engaging in sex with two boys who are youth hockey league teammates of her son.

Davis faces charges of unlawful sex with a minor and lewd acts with a child. According to Orange County Sheriff's spokesman Jim Amormino,

Davis was initially suspected of having an illicit relationship with one boy, but a second victim has surfaced, and there may be a third, Amormino said, adding that Davis's trysts with one of the youths took place at her home for a year and a half.

Of the two boys who authorities are certain had sex with Davis, one is under 16 and the other is under 14, Amormino said.

After arrest last Wednesday, Davis was booked into custody and released on $25,000 bond.
