(Fort Wayne, Indiana) In December 2006, a former corrections officer at the Northeast Juvenile Correctional Facility, Margaret A. Wiley, was arrested and charged with felony sexual misconduct and trafficking with a 16-year-old male inmate.
Last month, Wiley, 28, pleaded guilty to sexual misconduct in accordance with a plea deal. In return, prosecutors agreed to drop the trafficking charge at sentencing.
On Monday of this week, Wiley was sentenced.
After hearing from more than a dozen witnesses, including Wiley's husband, Allen Superior Judge Kenneth Scheibenberger ordered Wiley to serve 18 months on probation and to participate in the One Church One Offender mentoring program. So, Wiley walks. She gets probation but has a felony on her record. Interestingly and for the sake of comparison, it was only about a week ago that a female corrections officer at a juvenile facility in Colorado, Heather Rose Robbins, was sentenced to 10 years in prison for sex with a 16-year-old boy. Therefore, in a totally nonsensical extrapolation, boffing boys in Indiana is better than boffing boys in Colorado.
Because of the type of charge, Wiley does not have to register as a sex offender.
Though Scheibenberger had the ability to treat Wiley's conviction as a misdemeanor charge, he declined to do so. Instead, he convicted her of the felony.
"It's just not right under these circumstances," he said, referring to the misdemeanor treatment.
[Update 02/12/08]
Wiley Violates Probation
She has been in jail since December after she was accused of violating her probation by having what prosecutors Monday deemed "incidental" contact with a child younger than 18.One must suspect that Wiley has friends in high places because the Indiana justice system is doing everything possible to keep her out of jail.
As part of her probation, Wiley was prohibited from having contact with children.
Allen Superior Magistrate Robert Schmoll ordered Wiley placed back on probation after she admitted the violation, but under a "zero tolerance policy," and extended her probation by two months.
