Wisconsin Girl, 18, Gets Probation for Sex with Boy, 12 - Updated

(Juneau, Wisconsin) Eighteen-year-old Ashley Miller has been sentenced to two years probation for sexually assaulting a 12-year-old boy.
During sentencing, Dodge County Circuit Court Judge Andrew Bissonnette handed down the probation term to Ashley Miller on a misdemeanor sexual assault charge, with the stipulation that she have no contact with the victim and follow through on sex offender counseling.

A deferred prosecution agreement was reached on a felony charge of intentionally contributing to the delinquency of a minor. Miller was initially charged with two felony counts of sexual assault of a child under 16 years of age.
Although not specifically cited, concerns about Miller's mental competency might have contributed to her arguably lenient treatment by the court. In any event, if Ashley Miller stays out of trouble, she'll be able to go on with her life unencumbered by nasty felony convictions.

(Juneau, Wisconsin) An 18-year-old Beaver Dam woman, Ashley R. Miller, has been accused of engaging in sex with a 12-year-old boy.

At her initial court appearance Monday, Miller was charged with two counts of sexual assault of a child under 16 years of age.
On May 12, Beaver Dam Police detective Ryan Klavekoske went to Beaver Dam High School to interview student Ashley Miller about a referral from Dodge County Social Services about a sex assault complaint. During the interview, Miller admitted to having sex with a 12-year-old boy twice in the week before her 18th birthday at the boy’s residence.

Miller said she believed the boy to be 13 at the time of the incident, according to the criminal complaint.

The boy told a social worker that he had started “dating” Miller earlier this year and that the couple had sex four times over the period of a month, according to the criminal complaint.
Miller was released from custody on a $10,000 signature bond.


[Update 12/9/08]

At a plea and sentencing hearing today, Reserve Judge Daniel Klossner ordered a competency evaluation. There was reason to believe that Miller didn't understand what was occurring in the proceeding.
