(Fulton, Missouri) The case of babysitter Sarah Brown, 22, is experiencing legal fits and starts resulting from apparent miscommunication.
In June, Brown pleaded guilty to three counts of statutory rape of the 13-year-old boy in accordance with an agreement negotiated between the prosecution and Brown's attorney, Dan Briegel. Brown made it very clear that she was guilty of the offenses.
The plea deal contained a recommendation for five years in prison on each count, running concurrently, with the final determination to impose or suspend to be made by Judge Gene Hamilton.
During the sentencing hearing on Monday (10/20/09), however, Brown expressed her desire to change her plea to not guilty after finding out that she could be sentenced to prison. It appears that attorney Briegel had not adequately apprised Brown of the possibility that she would go to the big house because he misunderstood the plea agreement.
Consequently, Brown's case has been re-docketed for trial. (h/t TCAFP in Comments)
Missouri Babysitter Arrested for Sex with Boy, 13
[Previous 1/2/09 post]
(Hermann, Missouri) A local woman, Sarah L. Brown, has been arrested for allegedly engaging in sex with a 13-year-old boy she was supposed to be babysitting in the summer of 2008.
Reportedly, Sarah Brown met the boy and his family at church and yada, yada, yada, ... she ended up living in their house. At some point while babysitting, Brown got drunk and commenced having sex with the boy. Then the boy apparently alerted his parents in a "Hey, guess what happened?" episode.
Brown faces three counts of statutory rape in adjacent Callaway County, the presumed location of the alleged rapes.
