Speeding Tickets Based on Cop's Eyeball
(Columbus, Ohio) The Ohio Supreme Court has ruled that drivers can be ticketed for speeding based only on a cop's estimate of the speed.
The court said an officer's visual estimate is sufficient basis for a ticket if he is properly trained, certified and experienced.
Some Ohioans are upset.
Frankly, I suggest that determining someone is illegal just by looking at them is a form of profiling and all profiling based upon looks is advertised as unconstitutional. Of course, profiling provisions in the law may not apply to speeding cars.
However, I seriously suggest there's general agreement that some cars just look sleeker and faster than others and therefore would likely be subjected to more stops and more tickets. My own experience as a sports car owner supports the contention.
