FEMA reasoning is that removal of thousands of dead, charred trees, landscaping, and the rebuilding of over 500 homes may destroy what is left of the toad’s population in the area and would disrupt the mating season for this endangered toad.
This concept would be viable if it weren't for the bias involved with protecting endangered species from Federal agencies. With the Bastrop fire situation we have what amounts to a huge area of burned out cinders that the Feds want to remain as is because of the concern that any debris removal and construction may kill what’s left of the Houston Toad.
However, under these same circumstances the Feds would place a top priority on cleanup and restoration if a wind farm were to want to build here. As with other cases of endangered species, the law does not apply to the wind industry which kills over a half a million protected bird species per year in the US.
Thus, the endangered species act only applies to American citizens and private businesses who do not receive subsidies from the Federal government to keep them in business like the wind industry.

This law permits Secret Service agents to designate any place they wish as a place where free speech, association and petition of the government are prohibited. And it permits the Secret Service to make these determinations based on the content of speech.
Thus, federal agents whose work is to protect public officials and their friends may prohibit the speech and the gatherings of folks who disagree with those officials or permit the speech and the gatherings of those who would praise them, even though the First Amendment condemns content-based speech discrimination by the government. The new law also provides that anyone who gathers in a "restricted" area may be prosecuted. And because the statute does not require the government to prove intent, a person accidentally in a restricted area can be charged and prosecuted, as well.
Permitting people to express publicly their opinions to the president only at a time and in a place and manner such that he cannot hear them violates the First Amendment because it guarantees the right to useful speech; and unheard political speech is politically useless. The same may be said of the rights to associate and to petition. If peaceful public assembly and public expression of political demands on the government can be restricted to places where government officials cannot be confronted, then those rights, too, have been neutered.
Political speech is in the highest category of protected speech. This is not about drowning out the president in the Oval Office. This is about letting him know what we think of his work when he leaves the White House. This is speech intended to influence the political process.
This abominable legislation enjoyed overwhelming support from both political parties in Congress because the establishment loves power, fears dissent and hates inconvenience, and it doesn't give a damn about the Constitution. It passed the Senate by unanimous consent, and only three members of the House voted against it. And the president signed it in secret. It is more typical of contemporary China than America. It is more George III than George Washington.

Between 75 and 100 Chinese ring-necked pheasants were let loose from a pen at the Queener Ridge Pheasant Company sometime Wednesday night, said Linn County Undersheriff Bruce Riley.
The ranch, located at 40485 Queener Dr., raises the birds for "controlled release for the purposes of hunting and dog training," Riley said.
A statement sent to Bite Back magazine -- signed by the Animal Liberation Front -- took responsibility for the act and "liberating (the birds) into the night sky."

Abstract
Relations between the length of a sunspot cycle and the average temperature in the same and the next cycle are calculated for a number of meteorological stations in Norway and in the North Atlantic region. No significant trend is found between the length of a cycle and the average temperature in the same cycle, but a significant negative trend is found between the length of a cycle and the temperature in the next cycle. This provides a tool to predict an average temperature decrease of at least View the MathML source from solar cycle 23 to solar cycle 24 for the stations and areas analyzed. We find for the Norwegian local stations investigated that 25–56% of the temperature increase the last 150 years may be attributed to the Sun. For 3 North Atlantic stations we get 63–72% solar contribution. This points to the Atlantic currents as reinforcing a solar signal.

(Austin, Texas) A 32-year-old special education teacher at Lexington (TX) Middle School, Holly Lopez, has been accused of engaging in sex with two male teens, 13 and 14 years old.The student told police that he had regularly turned to Lopez for help in math, but as the year wore on, the student-teacher relationship took an inappropriate turn, Pflugerville police said in the affidavit.Lopez was booked into the Travis County Jail with bond set at $100,000.
On the night of the incident, Lopez arrived at the Pflugerville home of the student's friend with condoms and had sex with both teens, the affidavit said.
(Lake Jackson, Texas) A 25-year-old science teacher formerly at Brazosport High School, Shelley Linder, has been accused of engaging in sex with two male students.According to court documents, Linder had a relationship with a 16-year-old boy in 2009 and a 17-year-old boy a year later.Linder was booked into custody and released on Tuesday.
Sources close to the investigation said Linder invited the boys over to her home and seduced them.
A "sophisticated cyber-attack" on the BBC has been linked to Iran's efforts to disrupt the BBC Persian Service.It appears the Iranian government is testing methods to electronically seal its population from the outside world.
In a speech Director General Mark Thompson plans to say that the internet attack coincided with efforts to jam two of the service's satellite feeds into Iran.
He will say: "We regard the coincidence of these different attacks as self-evidently suspicious."
Last month Mr Thompson accused Iran of intimidating Persian service workers.
Reporters Without Borders has also complained about Iran's "cyber-army".
The latest revelation follows a blog post by Mr Thompson in February in which he complained of the "repeated jamming of international TV stations such as BBC Persian TV, preventing the Iranian people from accessing a vital source of free information".
In his speech to the Royal Television Society he will note that on the day of the cyber-attack there had also been an attempt to disrupt the Persian Service's London phone-lines by the use of multiple automatic calls.
