Babysitter Gets No Jail for Killing Her Sister, 7

(Greeley, Colorado) A 16-year-old babysitter, Heather Trujillo, was charged with killing 7-year-old Zoe Garcia during reenactment of Mortal Kombat video game moves -- including kicking, punching and body slamming -- in December of 2007.
Police say on Dec. 6, 2007 Trujillo, who was 16-years-old at the time, and Roberts while baby-sitting Trujillo’s younger sister Zoe Garcia hit, kicked and body-slammed Zoe in a live version of the video game, "Mortal Kombat."

When police responded to Trujillo's home in Johnstown Zoe was not breathing. She later was pronounced dead at North Colorado Medical Center.

The Weld County Coroner's Office ruled the death a homicide, saying Zoe died from blunt-force injuries.
Trujillo and her boyfriend, 17-year-old Lamar Roberts, were arrested and charged as adults for child abuse resulting in death.

In accordance with a plea agreement, Trujillo, now 17, pleaded guilty to the charge and, yesterday, Weld County Judge Marcelo Kopcow sentenced her to an 18-year suspended prison term. She was ordered to complete a six-year Youthful Offender System program.

Roberts has a preliminary hearing scheduled for next week. According to a witness statement:
Roberts said he had kicked Zoe Garcia multiple times while drunk, body slammed her and bragged that his hands were "lethal weapons," and were "registered in the books.”
Roberts faces a charge of felony child abuse causing death. Trujillo will testify against him as part of her plea deal.
