Texas Foster Mom Gets 90 Days for Sex with Foster Son - Updated

(Brownwood, Texas) Twenty-six-year-old Phylecia Humphries was convicted by a jury last Friday of second-degree sexual assault of a child stemming from a relationship with her 13-year-old foster son which ultimately led to a pregnancy and birth of a daughter.

Despite prosecutors recommendation that she spend 180 days in jail, Judge Steve Ellis sentenced Humphries to 90 days in the county jail and 10 years of probation.

Humphries was also ordered to register as a sex offender and prohibited from associating with children under 17 without permission of the court.

A relative is caring for the baby girl.

Texas Foster Mom on Trial for Sex with Foster Son

(Brownwood, Texas) A 26-year-old former foster mother, Phylecia Humphries, is on trial in the 35th District Court for allegedly engaging in sex with her 13-year-old foster son in 2005.

Humphries faces a charge of sexual assault of a child. Notably, a significant complication from the sexual relationship resulted in a child being born. DNA testing confirmed that the boy fathered the child.
During opening statements, District Attorney Micheal Murray, told the jury that the boy began living in the home with Phylecia and Michael Humphries in February 2005, during the second half of his sixth-grade year. Murray said Phylecia Humphries and the boy began to have sex later that summer before he entered the seventh grade.

Murray described the first encounter that led to numerous other alleged sexual encounters between the foster mother and her foster son.

“He can’t begin to tell you how many times he had sex with Mrs. Humphries,” Murray said.

Humphries became pregnant, Murray said, and the relationship ended.
Defense counselor Kirby Roberts argued that Humphries has mental issues from a dysfunctional and abusive childhood.

Meanwhile, Humphries likely faces additional sex assault charges regarding a relationship with a different teenage foster son, a 16-year-old.

Conviction in either of the cases carries a possible two to twenty years in prison. Humphries is currently free on bond.
