Sex Case Dismissed - Updated

(Yuba City, California) The felony rape charge against 38-year-old Michelle Goldsmith has been dismissed.
Visiting Judge Carl Bryan made the ruling after a witness at the preliminary hearing testified Thursday that he saw Goldsmith unconscious in a closet at the apartment in the 1300 block of Dustin Drive and the teenage boy on top of her with his pants down.

"He was working on trying to get her clothes off," testified Chris Walters, a resident of the apartment who knows Goldsmith's daughter.

Walters said he pulled the teen boy off of Goldsmith, who was visiting the apartment May 18, 2010.

The prosecution must show probable cause at a preliminary hearing to hold a defendant to answer for a felony charge.

California Woman Accused of Lewd Act with Boy

(Yuba City, California) A 37-year-old blackjack dealer at Feather Falls Casino, Michelle Lorraine Goldsmith, was arrested this week for allegedly committing a lewd act with a boy no older than 15.
About 10:30 p.m. Tuesday, officers were called to 1300 block of Dustin Drive, where Goldsmith was arguing with other adults about the alleged lewd act, said police spokeswoman Shawna Pavey.

"We had enough evidence at that point" to arrest Goldsmith, said Pavey.

Pavey said she could not release information about the alleged act because of the victim's age.
Goldsmith was booked into custody at the Sutter County Jail with bail set at $50,000.
